CORROBORATING THE ACCUSATION OF NEVZLIN L.B. OF ORGANIZING CRIMES COMMITTED AGAINST THE GORINS – GORIN S.V. AND GORINA O.M.

“The defendant Nevzlin L.B., during the preliminary investigation of the case, under interrogation as a witness on May 4, 2003, said the name doesn’t say to him anything, he, for the first time it from mass media in connection with the arrest of the employee of the security service of the oil company Yukos Pichugin. He doesn’t know who is involved in the killing of the Gorins, and he doesn’t know either about the reasons of the killing. With has no ties at all, he personally has not contacted with Pichugin, he didn’t give him any assignment and didn’t discuss it with him.

Pichugin A.V., accused of organizing the murder of the married couple Gorins by the Verdict of the Moscow City Court that has become final and biding, in the courtroom, refuse to five any evidence having used the right provided by Article 51 of the Constitution of the Russian Federation.

However, under interrogation as a witness and suspect on May 27 and June 19, 2003, Pichugin A.V. said that had got a job in the security service of the bank ‘Menatep’ in 1994, then held the position of the head of the 4th department of the security service of the oil company Yukos. His official duties was to guaranty security of the activities of the mentioned bodies.

In 1995, he got acquainted with Gorin, who, at that moment, was being fired from a representation of the bank in the town Tambov. Gorin proposed to provide help tp the security service of the bank. Gorin often came to him to Moscow, including with his wife. In 1998, the couple Gorins lived in the town Vidnoye. In 2000, he went to the town Tambov to Gorin for the baptism of his son. He knows that, at that moment, Goring lived in a private house located outside the town Tambov. Gorin periodically asked to provide assistance in finding a job for him and his spouse.

He agreed with one of the acquaintances about employment for Gorin in the town Rostov. The question was about an employment at a gas station in the Rostov Region. About this proposal he told Gorin, but he, at the set date, specifically, on November 21, 2002, didn’t come to prepare certain documents. He called him at his home, and from Ms. Dedova (   rsation with Dedova, he managed to learn the circumstances of the event and that, on the scene of the event, traces of blood and brain had been found.

The guilt of the defendant Nevzlin L.B. of organizing the killing of the couple Gorins is corroborated by the following proofs:

- Statement of Peshkun A.V. of 11.07.2003, on July 12 and 19, in the Moscow City Court, according to which he is reporting that Pichugin A.V. and his boss Nevzlin are implicated in organizing of the attempted murders against Kostina, Kolesov, Rybin, as well as to the murder of the couple Gorins.

- Testimony of the witness Peshkun A.V., both during the preliminary investigation and in court, according to which his statements about complicity of Pichugin and Nevzlin, as organizers, in attempted murders against Kostina, Kolesov, Rybin, and the murder of the Gorins, Sergey and Olga, are based on veracious information at his disposal and received from Gorin S.V. In speaking with him, Gorin repeatedly said that not only Pichugin was the organizer of the crime, specifically, the attempted murder of Rybin, Kostina and Kolesov, but there was a more powerful organizer – Nevzlin.

The first conversation about the involvement of Nevzlin in the mentioned crimes took place with Gorin around 1999, when he and Gorin, while being in Moscow, on the Sakharov Prospect, near the bank ‘Menatep’. Gorin came out of the premises of the bank and was waiting for someone. They started to talk about executors of the orders with regard to Kolesov and Kostin. At that moment, Gorin, for the first time, said that, behind all these crimes stood not only Pichugin, but also the main organizer Nevzlin. From the words of Gorin, he knew that Pichugin was handing over money and fulfil the will of Nevzlin. In particular, he connected the name of Nevzlin with the attempted murders against Kolesov, Kostina and Rybin.

He has been acquainted with Gorin since 1992. During the period 1993-1994, he worked for him as a chauffeur in the town Tambov, in the firm ‘Algoritm’ dealing with attraction money of the population. The head of this firm was Gorin. In 1996, Gorin, after the firm ‘Algoritm’ ceased to exist, started to deal with the opening of an affiliate of the bank ‘Menatep’ in the town Tambov. Gorin was going to Moscow and there was having talks with the management of the bank ‘Menatep’. From conversations with him, he learned that he was in contact with Pichugin, an employee of the security service of the bank, who had promised to help Goring with finding a job.

He met Pichugin in 1997-1998, via Gorin, end explained that he, Pichugin, was the head of the security service of the oil company Yukos. The meeting took place in the vicinity Puchugin’s office, house No 23, Vavilova Street, in Moscow. The last several years Gorin and Pichugin had been in close contact. In particular, Gorin, together with Pichugin, took an effort to dismiss the head of the firm ‘Tambovnefneprodukt’ Plakhotnikov.

In August 1998, Gorin proposed to him for monetary remuneration amounting to 5 000 US dollars, to commit a crime in Moscow against Kolesov and Kostina. Gorin, for committing these cries was to receive 20 000 US dollars, 6 000 of which Gorin planned to pay to executors of the crimes. He, Gorin, in his turn, proposed to commit these crimes to Popov, who, acting together with Korovnikov, Kabanets and Erbes, fir monetary remuneration to the amount of 3 000 US dollars, made an explosion bear the door of Kostina’ apartment.

Later on, from the words of Gorin, it became known that the crime against Kolesov was committed by another group.

Gorin repeatedly at meetings with Pichugin tried to solve the question about a job. In the spring of 1999, he, together with Gorin, came to the CJSC “Moscow Youth Palace’ (MDM), where a meeting took place with Pichugin, and on that day, on TV, information was translating about the attempted murder against Rybin. From the following conversation with Gorin, he learned that Pichugin was spiteful. As the money for killing Rybin had been paid, but the killing had been not committed. Having learned that Rybin was alive, Gorin was very nervous and said that it was necessary to kill Rybin, as the money for that had been already received by him.

The Money in US dollars were handed over to Gorin at the meeting with the latter with Pichugin in the CJSC ‘MDM’. He saw it in the Gorin’s bag. Moreover, Gorin said that the work of killing Rybin had to be fulfilled to the end.

After failed attempted murders against Rybin and Kostina, conflicts started to emerge between Gorin and Picvhugin. From Pichugin Gorin went away nervous, he was afraid of surveillance, and asked to use devious paths.

In the autumn of 2000, Gorin addressed him with a request to hide a sub-machinegun in his place, that was disassembled and was equipped with a silencer. The sub-machinegun was geared to use rounds from the Handgun Makarov. When Gorin received a negative answer to that, he, Gorin, threw away the parts of the sub-machinegun in the field near his house.

After apprehension of the executors of the crime against Kostina, Gorin asked him to do out of town for a while and explained that he had received an instruction from Pichugin personally about the his elimination in order to prevent leaks. Having seen them together, Pichugin started to boil over and voiced complaints to Gorin.

Later on, between Gorin and Pichugin there was a conflict in connection with Gorin’s intention to make public the involvement of Pichugin in organization of crimes against Kolesov and Kostina. Gorin started to express fear for his life, specifically, when he was preparing for a regular meeting with Pichugin, he warned that, in case he didn’t return, it would be necessary to contact his (Gorin’s) wife, as she knew, what to be done in such a situation, and she disposed of some information with regard to Pichugin.

For one of such meetings, Gorin took a knife with him, and, upon that, said, if something happened to him, so Pichugin would be guilty of that. Such fears for his life Gorin expressed because of his mutual criminal activity with Pichugin. At one of the meetings, Gorin hinted to Pichugin that, if he wouldn’t come, at at certain time. To his car, on which he was to be driven to the town Tambov, then unrecoverable events would happen.

Due to the fact that Pichugin didn’t help Gorin with finding a job, the latter rendered him a ‘bill’ to the amount of 100 000 US dollars for fruitless trips to Moscow and spending his time on organizing gas stations in the town Tambov. Moreover, Gorin. In case of Pichugin’s refusal to satisfy his demands, promised to make public information about the crimes committed by Pichugin.

The relations between them sharpened even more. In May 2002, Gorin met with Khodorkovsky B.M. and told him about what he had done for the oil company Yukos, and after that they refuse to pay him money and to provide help in finding a job. Having learned about this meeting, Pichugin started to voice his claims to Gorin.

Later on, Pichugin rendered to Gorin his own account to the amount of 100 000 US dollars. Moreover, Gorin said that they had handed over to him a bag with 40 000 US dollars, and at the request to return to him (Peshkun) the debt, he explained that he had to transfer the money to someone in the town Tambov. Yet, being still in Moscow, he bought a car ‘Sobol’, and later started to actively construction works near his house.

Information about his meetings in Moscow Gorin wrote in a notebook that he kept in his safe, located in the basement of his house, and hid its content.

On November 2002, Gorin planned to go to Pichugin for solving the problem with finding a job. Yet, on November 21, 2002, he learned about the disappearance of Gorin and his spouse Olga. Moreover, he says that the death of Goring and his spouse was beneficial specifically to Pichugin and Nevzlin. After the crimes committed against the Goring, he started to fear for his life and for the life of members of his family.

Earlier, during the preliminary investigation, he didn’t provide evidence pertaining to the involvement of Nevzlin in organization of crimes, because he feared for his life and health, as well as for the life and health of his close relatives.

- Testimony of the witness Smirvov O.M., both during the preliminary investigation and in court, according to which he made acquaintance with Gorin in 1999, when, withing the framework of the investigation of the criminal case was withdrawing a rifle from him. Later, he drove Gorin to Moscow, to Vavilova Street, where he discussed with Pichugin, an employee of the security service of Yukos, the question about his employment. Gorin himself said that Pichugin could resolve the question about dismissing of Gorins acquaintance Borodulin, he was in a position of the head of the security service of the oil company Yukos in the town Tambov.

Durign the conversation with Gorin he learned that Puchugin via Gorin ordered a killing of a man in Moscow. Gorin decided to engage for this Peshkun, who, in his turn, recommended Korovnikov and friends of the latter as people ready to fulfil any assignment. He is sure that Gorin told about an order for murders which had to be presented as a killing from hooligan motives or with the purpose to rob. About the order of the murder knew also Peshkun, so much so that Gorin specifically through him conveyed the order to Korovnikov.

In July-August 2001, Gorin went to Moscow for a meeting with the father of Khodorkovsky M.B. Gorin was intended to convey him information, as the result of which they would dismiss his request for a job. The conversation lasted for about one and a half hours. After that, Gorin said that he had told Khodorkovsky about the attempted murder against Rybin and had expressed his intention, just in case, to go to Rybin. Khodorkovsky promised to talk to his sun and then to call Gorin. Having returned to the town Tambov, Gorin started to wait for the call of Khodorkovsky-senior.

In one and the half or two weeks, Pichugin called Gorin and expressed his displeasure that Gorin had had met with and talked to Khodorkovsky (senior). Pichugin promised that the question with Gorin’s employment would be soon resolved.

He knows that Puchugin via Gorin ordered another series of murders, in particular, a murder of a woman, which took place in January 1998 in Moscow, and, apart from that, two attempted murders were organized against Rybin. Gorin told him about the circumstances of committing these crimes.

In the summer of 2002, Pichugin gave Gorin 40 000 US dollars, but, after certain time, demanded the money back from Gorin, with the condition to give it back later.

In the middle of November 2002, Gorin called and said that it was necessary to go to Moscow, as Pichugin had said that the question with his employment had been resolved. Before the trip, Gorin said that, if Pichugin would not solve this question, he would go to a meeting with Nevzlin, explaining, that Nevzlin was ‘the gray cardinal’ of the company Yukos and that he (Gorin) had solved also Nevzlin’s questions.

As to Pichugin, Gorin explained that Pichugin was sneaking and loved to gratify everybody. His hade his career thanks to his wife, who is relative of one person from the leadership of the company Yukos.

On November 21, 2002, at about 7 o’clock, by previous arrangement with Gorin about a trip to Moscow, he came with his car to Gorin’s house. He knocked at the gate, but nobody came out. At about 9 o’clock, the Gorins’ nanny appeared. She said that the Gorins should have opened the door at that moment. He thought that something had happened, and after that came over the fence. The gate of the house was propped with pickets. He removes pickets and with the nanny came into the house, where he heard children’s cries coming from the bathroom. The door of the bathroom was blocked by a cupboard. He moved it away. There were three children in the bathroom – Olga of 15 years, Dmitry of 14 years and Alexey of 2 years. There was blood on Dmitry’s head.

From the words of Dmitry, he learned that in the evening, on November 20, 2002, at about 19 hours 40 minutes, when the parents went to a shop, an unknown man in a mask penetrated into the house. The man, threatening with a handgun with a silence, brought the children into the bathroom. Dmitry tried to resist, grab the alarm clock and tried to hit the man. In response, the man hit Dmitry with the gun butt on the head. The sounded the voice of his mother, who was talking to several men. After that they didn’t see or heard anything.

During the inspection of the house it was found out that from the safe vanished gold objects. Also vanished was the car ‘Volga’. Before the garage, on the crushed stones and inside the garage, there were traces of blood. Gorin earlies had said that, in case something happened to him, his wife would know where to go.

Having understood that the death of the Gorins was most beneficial and desirable for Pichugin, he called Pichugin and told him that Gorin had left information and had asked to make it public in case something would happen to him. After he mentioned in speaking with Pichugin the names of Rybin and Kondaurov and that he intended to meet the latter, Pichugin was taken aback, but then proposed to meet, but he refused. After that, he called Pichugin, but neither he, nor his secretary, picked up the phone.

1.5 - 2 months before the disappearance of the Gorins, the latter (Gorin) had a meeting with Pichugin in Moscow. After that meeting with Pichugin, Gorin returned unsatisfied. When they were returning to the town Tambov, Pichugin called Gorin of this mobile phone, told him about possible employment and asked Gorin to call him in a week. The Pichugin set a meeting for Gorin, but then postponed it. A day before the crime committed against the Gorins, Gorin tild that Pichugin had set a meeting with him on the next day in Moscow.

- Testimony of the witness Korovnikov I.O., both during the preliminary investigation and in court, according to which he has been acquainted with Peshkun since 1997. In 1998, on Peshkun’s proposal, for monetary remuneration to the amount of 15 000 US dollars, to commit the murders of Kolesov and Kostina, he, acting together with Popov, Kabatets and Erbes, set off an explosion near the door of Kostina’s apartment.

Having known that Kolesov came to home flowered by his guard, they, having informed about that Peshkun, decided, in coordination with him, not co commit this crime. Later on, Peshkun said that the crime against Kolesov had been committed by other persons and that they had received for that 5 000 US dollars.

Peshkun said that the proposal to murder Kostina and Kolesov, came from Pichugin. In effect, just before committing the crime against Kostina, there was a meeting with the ordering customer of crimes, which had taken place near the Paveletaky Railway Station. To this meeting, in one car, came Peshkun and Gorin, and in the second one Pichugin, who had not got out of his car, but he had reconnised him through the window sitting in this car. During this meeting, Pushkun was caming to Pichugin’s car and was coordinating with him the terms of committing this crime, Peshkun handed over a telephone number of a person whom it was necessary to inform before committing this crime against Kostina, and explained that the ordering customer would fly out of Russian’s boundaries to guaranty his alibi.

The conditions of committing the crimes against Kostina and Kolesov, Peshkun coordinated with Gorin, and, apart from that, it is known that Gorin was his boss. Peshkun introduced him (Korovnikov), as well as Popov, Kabanets and Erbes to Gorin as executors of the crime against Kostina.

After the explosion made near the apartment of Kostina, Gorin and Peshkun reported that everything had gone well, and that Pichugin had been satisfied, and. From the words of the latter, he needed such people, who explode and kill, and he also promised to pat a bonus amounting to 2000 US dollars. That bonus, referring to the refusal of the ordering customer to give money, Gorin didn’t pay.

That said, Gorin and Prshkun, because of some emerged problems, tried sell all their belongings. From their words, in became known that there was an urgent need for them to square accounts with the ordering customers.

Having no confidence in Gorin and Peshkun, he, in January 1999, called in Moscow a person who had asked to contact him before committing the crime to guarantee his alibi. Over the telephone, he said that he is from the brigade of building workers from the town Tambov, who specifically was dealing with the renovation of the house’s entrance. The person understood what was it all about and proposed to come to Moscow to the same place where earlier the meeting had taken place. Moreover, he had to have on the same cloches, as during the previous meeting, which had taken place just before the explosion. That is, in the course of the conversation the place of the meeting was not mentioned, but it became clear to him that the meeting would take place on the Paveletsky Railway Station. He came to the place of the meeting a bit earlier and, when he was moving to the central entrance of the railway station, somebody called him by his name. Having turned around, he saw Pichugin.

During the conversation, Pichugin approved the explosion, however, he said that the crime against Kostina had to be brought to completion. Then, using unflattering words about Gorin, he gave to understand that the latter had received considerable sums of money for committing crimes against Kostina and Kolesov, and explained that to the executors of the committed crimes with regard to Kolesov, a monetary remuneration had been pain to the tune of 5 000 US dollars.

Pichugin, having said that Gorin were collecting compromising materials about everybody, proposed a monetary remuneration to the amount of 50 000 US dollars for the coming the crime against the Gorins stage it as a family conflict and a suicide, or a monetary remuneration to the amount of 20 000 US dollars for the same crime, but stages as a robbery.

Then, as a bonus to making the explosion near the door of Kostina’s apartment, Pichugin proposed the car ‘Audi’, of red color, what was in the town Tambov in use of Gorin and his entourage. Later on, Goring started to express claims pertaining to his (Korovnikov) meeting with Pichugin, explaining that he was afraid that, because of that, a death warrant was signed for him. He didn’t inform Gorin of Pichugin’s proposal to murder him and his spouse. Gorin said that he had some documents and photos that he wanted to pass over to him. On the next da, Goring handed over to him an office file with same papers, at least 10-15 pages. On the top, there were three color photos of men. On one of the photos was Pichugin. Gorin explained that these were persons that ordered the murders of Kostina and Kolesov, as well as other crimes unknown to him (Kolesov).

Pichugin was busy collecting people for committing crimes. Gorin stressed that, if something happens to him, a murder or an accident – only Pichugin will be implicated in that. In that file, there were also copies of bank documents. Gorin specified that the persons of these photos were connected with the bank ‘Menatep’, and the copies of bank documents were compromising materials on this bank and that they could be transferred to law enforcing agencies id something happened. He was intended to keep this file and to become periodically financial remuneration from Gorin. As he understood that he, in effect, was a guarantor of living for Gorin and his relatives.

From the photos presented to Korovnikov I.O. for recognition, he pointed out to the photo of Nevzlin and specifies that he looked like an employee of the bank ‘Menatep’ and hose photo had been shown to him earlier by Gorin.

- Protocol of identification of a person with the help of a photo, according to which Korovnikov I.O. indicated the photo with the picture of Pichugin on it and explained that he looked like one of the managers of the bank ‘Menatep’ the photo of which Gorin had given to him.

- Testimony in court of the witness Kabanets V.N. from which follows that, in summer 1998, a proposal was made to him from Korovnikov, for monetary remuneration amounting to 2000 US dollars to commit a crime against Kolesov and Kostina. He, acting together with Korovnikov, Popov and Erbes, set off an explosion near the door of Kostina’s apartment. The actions with regard to committing this crime he coordinated with someone in Moscow, including during the meeting on one of Moscow’s railway stations. From the words of Korovnikov, he understood that the persons who had ordered the crime against Kostina, was dangerous for themselves (for Kabanets, Korovnikov, Popov, Erbes) and members of their families.

- Testimony in court of the witness Popov P.A., according to which, in 1998, a proposal came from Peshkun to commit a crime against Kolesov and Kostina. Hr, afting together with Korovnikov, Kabanets and Erbes, set off an explosion near the door of Kostina’s apartment.

Taken into consideration that Kolesov came home accompanying by a chauffeur, in coordination with Peshkun, refused to commit this crime.

Before committing this crime afainst Kostina, Korovnikov on the Paveletsky Railwat Station in Moscow, met with Peshkun, who had come on an SUV followed by another SUV, in which there were sitting some men. On the SUV that Peshkun came to the Paveletsky Railway Station in, the was a registration number of the Moscow Region. Peshkun in this car had come to the station of technical inspection in the town Tambov. Then, together with Peshkun, there was another man, and Peshkun behaved himself solicitously towards him.

- Testimony in court of the witness Erbes D.P. that is similar to the evidence of Korovnikov, Kabanets, Popov, but it is added by the fact that he heard from Korovnikov about the orders regarding the mentioned crimes were coming from Gorin and Pichugin, and, moreover, Gorin received money from Pichugin.

- Testimony of the affected Dedova G.A. (mother-in-law of Gorin S.V.) both during thew preliminary investigation and in court, according to which her daughter Ismailova Olga received a job in the affiliate of the bank ‘Menatep’ in the town Tambov, headed by Gorin Sergey. In 1999, Ismailova contracted a marriage with Gorin which whom she started to live in house No X on Yasnaya Street of the community Raduzhny if the town Tambov. Dirung the period 1998-2000, the Gorins worked somewhere in Moscow. When they returned back to Tambov, Gorin continued periodically to go to Moscow.

In August 2000, for the baptism of the Gorins newly born sun, came Pichugin . From the words of Gorin, he has been acquainted with Pichugin for about 8 years. Later on, Sergey tried to get a job in the oil company Yukos, but nothing came out of it. Gorin counted in this question only on Pichugin. For a long period of time, the latter had been promising to the Gorins to provide a job, but had done nothing for that. Gorin said that Pichugin could have get a job for him had he wanted to.

At the beginning of 2002, she saw receipts of the Tambov affiliate of the bank ‘Menatep SPB’ on the account with 9 500 US dollars on it. Gorina O. explained that the money had been given for construction of underground passages in the town Tambov. After a while, she learned that the Gorins had return the money back.

In July 2002, she learned that Gorin had bought a car ‘Sobol’. Where Sergey got money for the car and for construction of the brick fence and backhouse buildings, she doesn’t know.

On November 20, 2002, arounfd17 o’clock, she for the last tine spoke with Gorin. At 23.30 o’clock and next morning she called Gorin but nobody answered her. After a while, Smirnov came to her and her grandson Dmitry. The latter told that, in the evening, when the parents had gone to a shop, an unknown man in a mask had penetrated in their house, he had hit him with a gun butt, and after that closed them in the bathroom together with his sister Olga and brother Alexey. Dmitry heard some men’s voices, as well as the voice of his mother. They stayed in the bathroom till morning, when they were let go by Smirnov and the nanny.

She, together with Smirnov, once again returned to the Gorins house. There was chaos in the rooms and traces of struggle. Then it was found out that two mink coats and gold pieces were missing. When she went down to the semi-basement, she found that a kitchen window was closed with a newspaper and a pillow. On the table, she saw the book ‘Million menus’, on the cover of which there was a writing which started with the words ‘Dear Mama!’ and ended with the word ‘Olga’. Earlier, there had been no such writing.

On November 24, 2002, during cleaning work in the kitchen in Gorins’ house. She found a cartridge, and she immediately reported about that to law enforcement bodies.

After the Gorins had disappeared, Pichugin started to call often and asking about investigative measures, and he also came to Tambov to find out the circumstances of the committed crime. Apart from that, she said that Smirvov asked her about the telephone number of Pichugin, and explained that he wanted to ‘con him out’. And, in a while, Pichugin called her back and wanted to know who from Gorin’s friend could know about him (Pichugin). At the regular meeting Smirnov told her that he had Pichugin on the phone and he had proposed to call him on February 15, 2003.

- Announced and examined in court the testimony during the preliminary investigation of the affected Gorin V.A., according to which his sun Gorin Sergey, every year, on August 6, came to the town Volgograd to visit the grave of his mother. From the conversation with his sun, he learned that Sergei had not worked for the last three years , once in a quarter, he went to Moscow with his wife in response to a call from representative of the bank ‘Menatep’, where he worked from three to seven days, and, with that said, he earned 50 000 UD dollars a year. The last time he saw Gorin on September 7, 2002, in the town Volgograd. After the disappearance of the Gorins, it became known to him that near the house, there this family had lived, cartridges were found, as well as blood and brain matter, and on the basis of that, he understood that they were not alive.

- Testimony in court of the affected Ismailov D.A., according to which, on November 20, 2002, in the evening, his sister Olga and his brother Alexey was at home, and the parents (the Gorins) went to a shop. When he with his brother watched TV in the kitchen, he heard that the entrance door banged. When he came to the room of his sister, he saw a man near that door and he had a handgun in his hand with a silencer. The gun was directed to Olga. On the head of the man there was a mask with slits for eyes. He grabbed from the console the alarm clock and tried to hit the man on the head. In response, hi hit him on the head with the handgun’s butt. From this blow, his spectacles broke, and blood started to flow from the wound. Then the man locked them in the bathroom, and later he brought there Olga and Alexey.

The man asked about the whereabouts of the parents. Having learned that they were in a shop, he made several telephone calls. When he tried to open the door of the bathroom, he heard three flaps. Then the man closed the door of the bathroom by a dresser. After a while, he heard the entrance door opened, and several persons entered into the house. They went to the basement. Among voices, he heard the voice of his mother who also went to the basement. One of the men said: ‘Don’t be stubborn, Olga Mikhailovna’. When they started to leave the basement, he didn’t hear the voice of his mother. The entrance door of the house banged two times, and then he heard a starting car engine.

All the night, they sat in the bathroom, an in the morning he learned that his mother Gorina O. and his step father Gorin V. had disappeared.

- Announce and examined in court, in accordance with Article 281 of the Criminal Procedure Code of the Russian Federation, testimoy of the witness Markovnikova L.V. from which it follows that she was a relative of Gorina Olga.

Approximately in 1998-1999, she acquainted with her husband Gorin Sergey. The Gorins for half a year lived in her apartment in the town Vodnoye of Moscow Region. From their words she understood that they dealt with trade and commerce, connected with banking activities. Gorina O. asked that during their staying in the apartment not to invite anybody and not to disturb, as Gorin S. didn’t like it.

In November 2002, from the relatives living in the town Tambov, she learned about the death of the couple Gorins. On April 17, 2003, she, at the request of Dedova G.A. (Olga’s mother) she accompanied her in Moscow, when she, together with several employees of the oil company Yukos, went to ‘clairvoyant’ woman and then, on insistence of the following her persons, she went to church for confession. During the time of conversation between Dedova and the employees of the oil company Yukos, the latter tried to learn something. Apart from that, one of these men, repeatedly stressed that he daughter Olga had suffered because of Gorin S.

- Announce and examined in court evidence during the preliminary investigation testimony of the witness Dronov A.I. according to which he, since 1996, has been occupying the position of the senior employee of the security department of the OJSC ‘Yukos-Moskva’, where, in the same year, he hat acquainted with Pichugin, who was his immediate superior.

In 1997, Puchugin introduced him to Gorin who was presented as a former employee of the Tambov, affiliate of the bank ‘Menatep’. Later on, Pichugin said that Gorin had been fired from the bank because of embezzlement. He met Gorin several times in the place of his word, when he came for meetings with Pichugin.

The last time he saw him in the summer period of 2002, and since then he has not seen him, and he knows nothing about his and wife’s whereabouts. He paid attention to the fact that, during a year before the disappearance, Gorin seldom came to their office, but it had been different in previous years, when he had come rather often.

On November 21 or 22, Pichugin invited him and Pavlyukov to his office where he said that he planned to meet Gorin on November 21, at 15 o’clock. However, Gorin didn’t come, and Pichugin was informer vie telephone that that the Gorins had disappeared. Pichugi asked them to call Dedova (mother-in-law of Gorin) in the town Tambov and to ask her about the current state of affairs.

In December 2002, he, together with Pichugin and Pavlyukov, went to the town Tambov to Dedova G.A. She showed them a piece of paper with a note on it: ‘We have to leave, will soon be back’, and explained that this note had been made by her daughter Gorina Olga. Apart from that, Dedova showed wiped out traces of blood on a wall in the kitchen located in the basement.

From the telephone conversation with Dedova in March-April 2003, he learned that in the garage they had found stuff, that, according to examination, had been defines as brain matter and had belonged to Gorin.

In April 2003, he, together with Pavlyukov, accompanied Dedova and her relative (Markovnikova L.V.) to a clairvoyant woman living in Moscow. Pavlyukov with Dedova entered into the house of this woman, and he with her relative, stayed in the car. Dedova returned with him and said that the clairvoyant woman had felt a weak (declining) energetics and had said that her children are alive, but that said, she had had nothing to say about their whereabouts.

- Testimony in court of the witness Veselov A.A., from which it follows that he, in 1995, was given a position of employee of the security service of the bank ‘Menatep’ in the town Tambov, headed by Gorin. Knowing that numerous inhabitants of the town were unsatisfied with the activities of Gorin in the finance company ‘Algotitm’, he wrote a corresponding background that was presented to Pichugin. After a while, at the request of Goring to introduce him to some employees of the security service of the bank ‘Menatep’ in Moscow, I gave him the telephone number of Pichugin.

Together with Pichugin, Gorin ‘implemented’ operative material relating to one of the employees of the bank ‘Menatep’. After that, Gorin came to him and promised to fire from the bank ‘Menatep’ and said that he had learned about that background from Pichugin. They started to more often call him to Moscow and presented claims, although Pichugin himself told him that he had no claims against him.

Gorin told that he had given his car ‘BMW’ to Pichugin. For the last time, he saw Gorin in 1998. Later, from mass media, he learned about the disappearance of the Gorins.

- Testimony in court of the witness Borodulin S.V. saying that he worked as deputy of security head in the affiliate of the bank ‘Menatep’ in the town Tambov, headed by Gotin. During the period of the working of that bank, he repeatedly met Gorin in the security service of this bank in Moscow. Gorin communicated with the employee of the security service Pichugin. When he took the job in the security service of the affiliate of the oil company Yukos in Tambov, Gorin addressed him with a request to provide a job in the affiliate for his spouse. According to him, Gorin acted through Pichugin.

- Testimony in court of the witness Ovsyannikov M.V., according to which he worked in the position of chief of the security service of the company ‘Algoritm’ headed by Gorin. By his duties, he had to go to Moscow together with Gorin, they came to the promises of the bank ‘Menatep’, or to one of its structural divisions located on Vavilova Street. One, he drove Gorin to the marriage of Pichugin what took place in the CJSC ‘Moscow Youth Palace’.

- Testimony in court of the witness Shevelev S.G., according to which he, since 1983, has been working as director of the Caucasus state nature biosphere reserve that is located on the territories of three subjects of the Russian Federation, specifically: Krasnodar Region, Republic Adygeya, Republic Karachay-Cherkessia. In July 2002, at the request of representatives of the oil company Yukos, he took part in organizing on the territory of the reserve holidays of senior management of the company. About 12 representatives of the senior leadership came, and they lived in a hotel located on the territory of the Republic Adygeya. Together with them came several members of personnel, whereas on excursions went only members of the leadership, and the personnel was waiting in hotel’s yard.

He personally guided tourist itineraries with participation of the members of the leadership of the oil company Yukos. Together with other leaders of the oil company Yukos, also took part in them Pichugin A.V. who, as it became known from mass media, was arraigned on a criminal charge for committing a series of extremely grievous crimes. In his presence, Pichugin A.V. communicated with other leaders of the oil company Yukos on equal footing, including Khodorkovsky M.B. and Nevzlin L.B.

- Statement of Dedova G.A. (mother-in-law of Gorin S.V.) of 21.11.2002, saying that, on November 20, 2002, an unknown person in mask, at 19.40 o’clock, penetrated into the house at the address: town Tambov, community Raduzhny, Yasnaya Street, house X, belonging to Gorin, where, threatening with a handgun, beat Ismailov D.A., and after that closed him, Gorina O.S. and Gorin A.S. in the bathroom, abducted the Gorins, stole valuable objects and disappeared from the scene of the event.

In the dining room, were found and withdrawn a towel, trousers and a shirt with traces of stuff of dark red color. In 50 meters to North-West from the fence, on the road, were found traces of a turn of a transport facility.

- Expert conclusion No 5544 of 29.11.2002, according to which the bullet, withdrawn from the rear trunk of the car GAZ-3110, state registration number В 540 ХК 68 РУС, was fired from a gun caliber 5.45 x 18 mm, homemade, or from a gas handgun IHZ-78, remodeled for using rounds MPTs of caliber 5.45x18 mm, or other weapon of caliber 5.45 x 18 mm, information about which is absent or is not itemized during examinations.

This bullet is part of a small-caliber handgun round of central hit (MPTs), caliber 5.45 mm, it’s a nominal round for self-loading small scale (PSM) handgun, caliber 5.45 x 18 mm and handguns IHZ-75, caliber 5.45 mm. The deformation of the bullet was caused by hitting a barrier.

The three cartridges withdrawn from the scene of the event: territory of the house X, community Reduzhnoye, Yasnaya Street of the town Tambov, z pieces of small-caliber handgun rounds of central hit (MPTs) , caliber 4.45 x 18 mm, with is a nominal rounds for self-loading small-scale handguns (PSM), caliber 5.45 x 18 mm, These cartridges can be used both in a gas handgun IHZ, caliber 4.45 x 18 mm, remodeled for using rounds MPTs caliber 5.45. x 18 mm, and for shooting with rounds and for using in self-made weapons made for use of the round (MPTs), caliber 5.45 x 18 mm, reference on which doesn’t exist.

The three cartridges presented for examination, were shot from one and the same kind of weapon. The presented bullet and three cartridges were made on a production line basis. The cartridges withdrawn from the scene of the event, were, probably, produced at one plant.

- Expert conclusion No 7108, of 08.12.2003, according to which two bullets and four cartridges withdrawn during the examination of the scene of the event, are made on a production line basis and are parts of small-caliber handgun rounds 5.45 mm of central hi (MPTs 7H7). These rounds are nominal rounds for a handgun 5.45 mm self-loading with central hit (PSM) and 5.45 mm sport and training handgun (IHZ-75).

The bullets could be fired from a barrel of a self-made weapon, in which, perhaps, is possible to use rounds caliber 5.45 z 18 mm (including from converted has or fire arm0. The cartridges could be shot from a 5,45-mm self-loading scall-scale Handgun (PSM), 5/45-mm sport and training handgun (IHZ-75), or from a self-made weapon with similar construction of percussion lock and locking mechanism, in which can be used rounds caliber 5.45 x 18 mm, including remodeled has or fire arm.

On one of the bullets, there traces emerged as the result of an impact with a relatively hard barrier, as the result of which the axe of the bullet could be deviated from the direction of the shot. In case of such impact, a ricochet was possible. On the second bullet no races of a ricochet were found. The bullets and cartridges were shot from one and the same kind of weapon.

- Expert conclusion No 3646 of 20.01.2003, according to which Ismaylov had a closed craniocerebral injury, contusion of brain with a wound in the right temporal region.

This corporal injury emerged as the result of an impact of a blunt and hard object, possibly, of a handgun butt, under circumstances and in time mentioned in the decision of November 20, 2002, and it causes a short term health problem for no longer than 3 weeks, but for more than 6 days, and, judging from this mark, is qualified as light damage to health.

- During a cytological examination it was established that the blood on the ground, gauze sponge, ragged stones, in the stuff of gray color belong to a man. While determining organ-tissue belonging of the stuff of gray color it was established that it is a stuff of brain.

The blood on presented to the examination two gauzes and ragged stones is related to the group A beta and belongs to a man, that is, I could have been of Gorin S.V. and could not have been of Gorin O.A. The blood on the presented for examination towel, T-shirt and trousers are related to the group O alpha beta and belongs to a man, that is, could be from Ismailov D.A. and could not be from Gorina S.V. and Gorina O.M.

The blood on the gauze sponge could be from Gorin S.V. and could not be from Gorina O.M. The blood on the right training shoe and on inflated ball, stuff from the car’s rear trunk could be both from Gorin S.V. and from Gorina O.M.

- Expert conclusion No 9/2/5 of 08.04.2003, according to which on the fragments of ragged stones, two gauzed sponges with traces of blood from the garage and stuff of human brain there are biological traces of Gorin S.V. Another gauzed sponge with traces of blood from the garage contains biological traces from Gorina O.M. The possibility of the origin of these biological traces of Gorin S.V. and Gorina O.M. is 69 billion against one.

- The Verdict of the Moscow City Court of Marth 30, 2995, that has become final and biding and, according to which Pichugin A.V., head of the fourth division of internal and economic security of the oil company Yukos, is adjudged guilty of organizing, by precious concert with other leaders of the oil company Yukos of intentional murder of the Gorins. Thus, evaluating the presented proofs, the Court has come to conclusion that Nevzlin, being a shareholder and first deputy of the president of the board of the bank ‘Menatep’, and later of the oil company Yukos, by previous concert, with the head of a division of the security service Puchugin A.V. and other unidentified persons from among managing employees of the bank ‘Menatep’ and oil company Yukos, has organized the above mentioned crimes against Korneyeva V.A., Petukhov V.A., Kolesov V.L., Kostina O.N., Rubin Y.L., Fedotov N.V., Ivanov A.U., Filippov Y.L.

Later on, recognizing that Gorin S.V. had at his disposal document and information of implicitly in committing crimes and in other illegal actions, information about which is to be found in the investigative materials of the case, and recognizing that Gorin was intended to make public this documents and information in case of non-payment of monetary remuneration and refusal to help find a job for him (Gorin) and for Gorina O.M., Nevzlin, entered into a criminal conspiracy with Pichugin and unidentified persons from among leaders of the oil company Yukos, with a purpose to hide committed by him (Nevzlin) crimes, organized and, with the help of Pichugin, who had selected persons unidentified by the investigation, on November 20, 2002, at about 19.40 o’clock, with the use of fire arms, the execution of the murder the couple Gorins - Gorin S.V and Gorina O.M., corpses of whom were transported to a place non identified by the investigation and haven’t been found yet.

About the fact of killing Goring near the entrance to his garage on the territory of his household, testifies the existence on that scene of the brain stuff that belonged to him. The criminal, on the scene of the crime, made at least 5 shots from fire arms. After the murder of Gorin, his corpse was moved to the right corner of the garage, where it lay for a considerable period of time, of which testifies a big amount of blood, and after that his corpse was wrapped in something and pun in the rear trunk of a car.

From Gorina O.M. for a certain period of time, in the kitchen located in the semi-basement, they tried to get information of interest for them, and of that testify the fact that the kitchen window was closed with pillows, and furniture moved. In the safe there was a search for documents containing compromising materials pertaining to Pichugion, Nevzlin and other persons from among the leadership of the oil company Yukos, and a proof of that is fact the door of the safe was left open.

Before the killing of Gorina, it was allowed to her to write a note for her mother about the alleged departure of he and Gorin S.V., and, obviously, it was done to postpose the time of their search, or for creating a hope that she would be alive if she would refuse to offer resistance during the transportation with the purpose of her further ‘interrogation’ and getting from her information in a safe place. About the fact of trying to stage the disappearance of the affected testify the fact of the theft of Gorin’s car.

Hiding of facts and circumstances of the murder of the Gorins indicates that the organizers of the crime were in close connection with the affected, and, in case of discovering the murder, would be under direct suspicion.

About a meticulous planning of the murder of the Gorings indicates the fact that Pichugin, to guarantee his alibi, intentionally informed several persons of his alleged meeting with Gorin on the question of his employment. Moreover, this meeting was constantly postponed, and that testifies that the preparations for the committing of the murder at the moment of the first tern of Gorin’s coming to Pichugin, was not complete, so, in connection with that additional time was needed, given that Gorin was ready to come to Pichugin any time.

Apart from that, about the preparations preceded to the crime, testify the fact that, in spate of measures undertaken in order to find places of possible disposal sites, the corpses of the Gorinns have not been found, which means that the corpses were transported to specially prepared places, or its elimination, and, most likely, far from the place of their disappearance. However, not-finding of the corpses cannot serve as a proof of non-culpability of Nevzlin and Pichugin of organizing the intentional murder of the Gorins couple, as for persons, involved in this crime, there was enough time to hide their corpses.
