During the preliminary investigation connected with the fact of the murder of Korneyeva V.A., Nevzlin L.B. was not interrogated, and he didn’t express his attitude to it in any other manner
“Accused by the Verdict of the Moscow City Court of 06.08.2007, which is final and biding, of organizing the given crime, Pichugin A.V. refused to give evidence in the current court session making use of his right provided by Article 51 of the Constitution of the Russian Federation. However, having been interrogated as a witness in this case pertaining to this matter on 15.04.1998, he gave evidence according to which, he, apart from being head of the security of the bank ‘Menatep’ was also employed as head of the department of economic security of the CJSC ‘Nekhstroyservis-M’, a subsidiary of the bank ‘Menatep’.
Nasarenko D.Y. is an employee of the security department of the CJSC ‘Tekhstroyservis’ and his (Puchugin A.V.) subordinate. In November 1997, he received an instruction from the management of the CJSC ‘Tekhstroyservis’ to make provisions for creating a closed joint-stock company which would make investments in overhauling of the building at the address: Moscow, Pokrovka Street, house 8/2 with participation of the LLC ‘Feniks’ what is the owner in this house of the premises of the shop ‘Tchay’. The project was to be provided also with services belonging to activities in the field of security. For negotiations with the management of the LLC ‘Feniks’ was sent Nasarenko D.Y. Soon Gorin S.V. started to take part in talks as in the capacity of director of the CJSC ‘Don-Grupp’ created for realization of this investment project. The founders of this company are the CJSC ‘Top-Master’ and CJSC ‘Pokrovka’ – subsidiaries of the bank ‘Menatep’.
According in the information that he had received by him from Gorin S.V., the director of the LLC ‘Feniks’ Korneyeva, at the end of 1997, gave a principal consent to participation of ‘Feniks’ in the investment project of ‘Gon-Grupp’. A form of the participation was to be worked out in the cause of further negotiations.
After the murder
of Korneyeva, Gorin and Nasarenko continued negotiations with the new director
of the LLC ‘Feniks’ Korneyev D.D. After a sertain period of misunderstanding,
having received information from Gorin, Korneyev D.D, also gave his principal
consent as to participation if the investment project with regard to overhauling
of the mentioned above building as well as to entering into the CJSC
‘Don-Grupp’. He was also aware that, in connection with the hearings in the
Basmanny District Court Moscow the case over the claim of the cofounder of the
LLC ‘Feniks’ Tarakhnelyuk V.G. who wanted to resign from membership of the
founders, constrains had been put on making deals with the property of the LLC
‘Feniks’. The bank ‘Menatep’ in interested in early closing of the litigation
and lifting of restrictions

the voluntary surrender and confession of Shapiro V.V. from
October 20, 2004, according to which Shapiro V.V. declared about his
participation in the murder of Korneyeva V.A.

- Statement of
Shapiro V.V. of March 25 and 31, 2005, according to which he
presents facts known to him regarding the involvement of certain persons from
the management of the oil company Yukos in committing of extremely serious
crimes, and in connection with this, he, really fearing for his life and
health, as well as for live and health of his close relatives, asks to take
measures guarantying his security.

- Testimony of Shapiro V.V. at the current session as a witness, as well as during the preliminary investigation, given by him as a witness, suspect and defendant, according to which he had known Gorin S.V. from 1978 and had kept friendly relations with him. Gorin repeatedly came to him in the town Volgograd, and he came to him in the town Tambov. Approximately, in December 1997, when he was staying with Gorin at the address: town Tambov, community Raduzhny, Yasnaya Street, h. XX, the latter made him a proposal to stalk a woman, the head of a shop, located in the town Moscow. As la later learned, this woman was Korneyeva V.A. Gorin said that he works in the bank ‘Menatep’, but this woman behaves herself incorrectly with regard to their company.
During the period from December 1997 to January 1998, he, under instruction of Gorin, together with Ovsyannikov M.V., had been trying to define personal data of Korneyeva V.A., location of work and domicile, connections and itineraries. They covertly followed Korneyeva moving in Moscow in the car BMW belonging to Ovsyannikov, ad VAZ 21099 belonging to Gorin, as well as on ‘Volvo’ that was given to them by one of the leaders of ‘The Moscow Youth Palace’.
The mentioned cars were driven by Ovsyannikov, and without his help he couldn’t have gathered information about Korneyeva, as he himself had a poor sense of direction in Moscow. Apart from that, he repeatedly stalked Korneyeva and her husband Korneyev D.N. near the house where they lived, as well as in the entrance of the house and in the elevator cabin.
Together with Gorin and Ovsyannikov, he lived in an apartment that Gorin rented, and it was located in the town Vidnoye of the Moscow Region. In January 1998, with the purpose to murder Korneyeva, Gorin handed over to him a firing arm – a small-caliber gun with a silencer as well as ammunition rounds to it. In January 1998, he together with Gorin and Ovsyannikov several times came to the house of Korneyeva with the purpose to kill her, but each time they could not decide to go ahead with the committing of this crime. On January 21, 1998, around 20.00 p.m., after drinking alcoholic liquors, he, together with Gorin under the command of Ovsyannikov, arrived to the house where Korneyeva lived.
After that, he, with the purpose to kill Korneyeva, came to the entrance hall of the house and went up to the stairwell landing between seventh and sixth floors. About 21.00 p.m., when Korneyeva and her husband came out of the elevator and came up to the door of their apartment, he descended the stairwell and in presence of Korneyev D.N. , from the distance of 1-1.5 meters, from a small-caliber hand-gun with silencer fired a shot to the right side of the head of Korneyeva who promptly fell. After that, he took the elevator and descended down, came up to the car, where Gorin and Ovsyannikov were waiting, and told them that he could not kill the witness of the murder, the husband of Korneyeva due to misfire. In the interior of the car, in order to hide traces of the crime, he changed into new clothes that had been prepared in advance. Trying to leave with other accomplices the scene of the crime, he dropped the hand-gun with silencer and ammunition rounds in a park belt.
In about a year after committing the murder of Korneyeva, Gorin presented him a new car, an SUV ‘Hyundai Galloper’, state registration number Р 844 ММ 34 РУС that he had bought in a car salon of the town Moscow. Documents for this car Gorin registered on him. He maintains that he committed the murder of Korneyeva V.A. in connection with persuasion, pressure and threats from the part of Gorin V.A., who was one of the organizers of this crime, and his trusted man Ovsyannikov M.V. who also took part in preparation and in killing of Korneyeva.
Apart from that, Ms.
Gorina O.M., as well as her spouse Gorin S.V., was persuading him to commit the
murder of Korneyeva saying that very serious people from the management of the
bank ‘Menatep’ and oil company Yukos, in case they refuse to commit this
crime, would not let live neither them, not members of their families. He is
aware that, in organizing this murder, Gorin S.V. acted in the interests of the
management of the bank ‘Menatep’, as the mentioned bank had a property dispute
with the manager of the ship in Moscow Korneyeva V.A. Part of the building
where this shop was located, belonged to the bank. Referring to the words of
Gorin, he knows for a fact that the ordering customers of this crime are
leaders of the bank ‘Menatep’ and the oil company Yukos who, in case in his
apprehension, would provide him a solid protection. The general guidance of
organizing this crime was in the hands of Pichugin A.V. who acted under
instructions of Nevzlin L.B. He also knows for a fact that the monetary
means for the preparation and execution of the murder of Korneyeva came directly
from, as well as further material remuneration for the persons who committed
it. The money came directly from Nevzlin to Pichugin, and the latter,
in his turn, handed it over to Gorin.

- The protocol of
the examination on the scene of the crime with participation of
Shapiro V.V., the photoboard, according to which Shapiro, in presence of
witnesses and a lawyer, recreated on the scene of the crime the circumstances
of its execution, in accordance with evidence that he had given earlier, in
particular, he showed the places from which they had been overseeing Korneyeva,
on the stairwell landing on the sixth floor of the house No 4 on the Chechulina
Street in Moscow. He also indicated his position and the position of Korneyeva
at the moment when he fired at her.

- Testimony of Ovsyannikov M.V. in the current court session as a witness, as well as during the preliminary investigation, given in the capacity of witness, according to which he has known Gorin S.V. since 1993. During the period from 1994 to 1995, he worked as chief security officer of the security department of the finance company ‘Algoritm’ in the town Tambov, headed by Goring. Then, approximately in a year, he left the company, but continued to but kept in touch with Gorin. He repeatedly transported Gorin, his wife and acquaintances by car to Moscow and back to the town Tambov. He also delt with servicing of the cars belonging to the Gorins.
In the Autumn of 1997, in Gorins’ house, he made acquaintance with Shapiro V.V. which had come to the town Tambov from the town Volgograd. He is aware that Gorin worked and acted in the interests of the bank ‘Menatep’.
So, in 1997-1998, Gorin tried to make a deal with Korneyeva about the purchase by the bank ‘Menatep’ of premises belonging to her and located in the building of the Pokrovka Street in Moscow. For that purpose, Gorin, during 1997, founded the firm ‘Don’Grupp’ that also acted in the interests of the group ‘Menatep-Rosprom’. Gorin tried to strike a deal with Korneyeva about purchasing of the premises of this shop or create a joint venture with her. However, Korneyeva turned down all proposals of Gorin and his employers from amongst managers of the bank ‘Menatep’.
He knows and Gorin maintained trusted relations with Pichugin A.V., head of a department of the company ‘Tekhstroyservis-M’ that was located in Moscow on Vavilov Street, house 23. Gorin repeatedly met with Pichugin. At the beginning of 1998, he, together with Gorin and his spouse, was present at the wedding of Pichugin in the premises of the Moscow Youth Palace. Pichugin repeatedly came to the town Tambov to Gorin. He knows that, when Gorin needed money, he received them from Pichugin. About accomplished work he reported to Pichugin and the latter reported about it to his boss Nevzlin. From the words of Gorin he knows that all financial flows came through Navzlin, including payments for preliminary measures in connection with this crime, as well as remuneration for its execution. From talks with Gorin and his spouse he learned that for salving all problems with regard to Korneyeva, Gorin received 300 000 US dollars.
Once he drove Gorin and his spouse to the near the house located on the Sagorodnoye Highway where was one of the offices of the bank ‘Menatep’. After a meeting with somebody, Gorin sain inside the car, that it was easier to kill Korneyeva. The house where Korneyeva lived, was designated by an employee of the company ‘Mekhstroyservis’ by the name Yevgeny. On one of the days, in November 1997, he, on his car BMW, state registration number А 524 ФФ 68 РУС, drove Gorin and his spouse to the house of Korneyeva in Moscow. This house was indicated to them by Yevgeny.
Then, in December 1998, he, together with Shapiro and Gorin, repeatedly stalked Korneyeva, found out her itineraries, drove Shapiro and Gorin in his cars to the house where she lived. The followed Korneyeva from following cars: BMW, state registration number Ф 524 ФФ 68 РУС, on Gorins car VAZ 21009, state registration number Ф 292 00 68 РУСas well as Volvo-240 that Gorin several times took from the parking of the CJSC ‘MDM’.
The Gorins, he and Shapiro dwelled in an apartment ranted by Gorin and located in the town Vidnoye on the Moscow region. The collecting of information about Korneyeva, in the words of Gorin, would help to create a joint-venture with her. Information about the financial situation of Korneyeva was to be provided by Pichugin.
On January 21, 1998, between 19.00 and 20.00 p.m., he, driving the car VAZ 21099, state registration number А 292 00 68 РУС, transported Shapiro and Gorin to the house where Korneyeva lived. After that, Gorin and Shapiro drank in the car a bottle of vodka, and then got out of the car and went somewhere. In about 15-20 minutes, Gorin returned to the car, and in 20 minutes after that Shapiro returned wo sat on the rear seat and promptly started to drink the rest of vodka, after that, they drove away from Korneyeva’s house. Following the instructions of Gorin and Shapiro, he pulled up the car near some park where Shapiro, for several minutes, left the car. Then they drove Shapiro to a metro station, where he got out of the car. He noticed that Shapiro returned to the car in a puffy jacket, but he left the car in a leather jacket ‘Pilot’. Together with Gorin, he returned to the apartment of the town Vidnoye.
On the next day, he heard that Shapiro and Gorin talked about something in raised voices. Then he learned from Gorin that Shapiro killed Korneyeva. After the murder of Korneyeva, he heard Gorin saying that he now holds Nevzlin by the balls. In the beginning of February, 1998, he heard the conversation between Gorin and his spouse from which he drew the conclusion that they put a certain man (Tarakhtelyuk V.G.) in line of fire who was arrested after the killing of Korneyeva, as well that with certain problems which arose in collection with the lack of a packet of some documents. Gorin also told him that he had killed two birds with one stone, as the woman was liquidated and her rival was arrested.
In February 1998,
in the town Vidnoye, Gorins’ car was VAZ 21099, state registration number А 292
00 68 РУС, was stolen. From the words of Gorin he learned that Shapiro, in
March 1998, demanded money from him. Then, in March 1998, from the conversation
from Gorin and his spouse, he learned that Nevzlin was to sign certain
documents and after that they would receive money. On the next day, he
drove Gorin to the office on Vavilova Street, house 23, in Moscow where Gorin
met with Pichugin. After his meeting, inside the car, Gorin handed over to him
7000 US dollars as payment for work.

- Protocol of
examination of evidence on the scene with participation of Ovsyannikov M.V.,
photoboard, according to which Ovsyannikov, in presence of witnesses and a
lawyer, reconstruction of the scene of the crime the circumstances of its
carrying out, in accordance with his earlier evidence, in particular, he
indicated the house No4 on the Chechulina Street in Moscow and said that in the
autumn of 1997, a certain Yevgeny had shown to Gorin the house in which
Korneyeva resided. Apart from that, Ovsyannikov showed the places from which a
covert observation of Korneyeva was exercised: namely, a part of the roadway in
the near of the house No 11, Chelyabinskaya Street, where, on January 21, 1998,
inside a car, he has been waiting for Shapiro; on a part of the urban forest,
located between the transmission towers no 77 and No 78 near Metallurgov Street
where Shapiro had left the car on January 21, 1998.

- The protocol
the simultaneous questioning of Ovsyannikov M.V. and Shapiro V.V.
according to which Ovsyannikov confirmed that, on January 21, 1998, he had
driven Shapiro and Gorin to the house of Korneyeva, and, on the next day, he
learned from Gorin that Shapiro had committed the murder of Korneyeva. He also
heard that Shapiro, in March 1998, had demanded money from Gorin. Shapiro
confirmed his earlier given evidence and said that Ovsyannikov had known about
the planned crime with regard to Korneyeva and had taken an active part in its
carrying out.

The abovementioned evidence of Shapiro V.V. and Ovsyannikov M.V. given repeatedly during the preliminary investigation and in court on the circumstances of preparation for the murder of Korneyeva and its execution, on his participation in this affairs together with Gorin S.V., on the order and organizing of this murder by Pichugin A.V. who had acted under the behest of Nevzlin L.B., and that the latter had finance the preparations and execution of this crime, and he had known in from the words of Gorin and his wife, so the court holds his as veracious, as well as evidence of Shapiro and Ovsyannikov in this part go along with each other and they are corroborated by other proofs in this case, in particular:
- Evidence of the witness Smirnov O.M., according to which he has known Ovsyannikov for a long time and has been keeping friendly relations with him. He met Gorin in the town Tambov, around 1997m when he went to visit Ovsyannikov M.V., and the mother-in-law of Gorin and Ovsyannikov lived in the same house. Later, during the investigation of the criminal case pertaining to the killing of Popov and Umansky, he, being a militia officer, withdrew a short rifle from Gorin. Later, Gorin helped him to buy in Moscow the car VAZ 2109. He had friendly relation with Gorin. After that, he repeatedly drove Gorin to Moscow, to the Vavilova Street, where he discussed with the security office of the oil company Yukos Pichugin the question of his employment.
From the conversation with Gorin he learned that Pichugin, for material remuneration, repeatedly ordered through him murders of peoples with which the oil company Yukos had different kind of problems. In December 1997, Ovsyannikov proposed him to commit a killing of a woman in Moscow, explaining that the presumptive effector of it, namely Shapiro, could not still take it upon himself to commit it. Later, from Gorin’s words, he learned that, in January 1998, the inhabitant of the town Volgograd Shapiro had committed the murder of a woman in Moscow. This woman had refused to sell a premises to one of the companies under control of the oil company Yukos. The order to kill that woman Gorin received from Pichugin who gave him 80 000 US dollars. Specially for committing this crime, Gorin bought a car.
Shapiro, for a certain period of time, didn’t have the heart to commit this murder. Just for the killing, Shapiro was transported by car to the house of this woman, where he drank vodka, and then, near the door of her apartment, from a hand-gun Makarov, fired a shot to the head of the woman in presence of her husband. Shapiro also tried to fire at her spouse, but because of a misfire, could not do it. In the entrance hall of the same house, a floor lower, Ovsyannikov waited for Shapiro and gave him another clothes. Having changed clothes, Shapiro threw away the old clothes and the hand-gun to the trash container, and then, together with Gorin and Ovsyannikov, fled in the car.
After the killing
of this woman, Gorin and Ovsyannikov asked him what could have been the cause
of the misfire of the gun that had prevented Shapiro from killing the witness
of the crime. Apart from that, Ovsyannikov complained to him that Gorin had not
paid him additional 5000 US dollars for committing the murder of this woman.
Later, from the words of Gorin and Ovsyannikov, he learned that Gorin had
handed over to the latter this sum of money for account of remuneration for
committing this crime.

- The protocol of
the simultaneous questioning of defendant with participation of the witness Smirnov
O.M. and the suspect Ovsyannikov M.V., according to
which Smirnov confirmed that in December 1997, Ovsyannikov had proposed to him
to commit a killing of a woman in Moscow. In January 1998, Shapiro, Ovsyannikov
and Gorin participated in the killing of a woman, and Shapiro personally
committed this murder and fire a shot in the head. Shapiro could not commit the
killing of her spouse, as the hand-gun misfired. At that moment, Ovsyannikov
waited for Shapiro in the same entrance hall, and Gorin in a car, next to the
house.

- Testimony of the affected Korneyev D.N. during the preliminary investigation and in court, according to which, on January 21, 19998, at about 21.00 p.m., he together which his spouse, on their own car, drove to the house No4 on Chechulina Street where they lived.
After that, they entered into the entrance No X of the mentioned house and mounted in the elevator’s cabin to the sixth floor. While leaving the elevator, he saw that on the stairwell landing to the left, near the apartment of neighbors, stood an unknown man. His right hand was bended in the elbow, with some cloth over it. He came to the door of the apartment No XX in order to open it, and his wife was behind him. At that moment, he heard a metallic sound behind his back.
Having turned around, he saw that his spouse was subsiding to the floor. He looked at the direction of the man whom he had seen on the stairwell landing while leaving the elevator, and saw that he was standing with his back to the doors of the elevator and was holding a short-gun with a long barrel in his hand. With a threatening gesture, this man directed the gun close to his head and said ‘Quiet, quiet’, and then entered the elevator’s cabin and descended on it.
He described in details the appearance and clothes of this man, as well as compiled his photocomposition portrait. He positively confirmed that he could recognized him. His spouse worked as director of the LLC ‘TF ‘Feniks’ and was also one of its founders. Prior to the murder, she conducted negotiations with representatives of the bank ‘Menatep’ as regards to selling or exchanging the premises of the shop ‘Tchai;’ belonging to her, at the address Moscow, Pokrovka Street, House 82, Building 1. Persistent propositions of the bank ‘Menatep’ were rejected as unprofitable for the partnership. At the same time, his spouse was very afraid of something and was taking various precautionary measures.
After the death of his spouse, their younger sun
Korneyev D.D became director of the LLC ‘TF’ Feniks’. The latter was repeatedly
addressed by Gorin, a representative of the bank ‘Menatep’. According to his
mind, the death of his wife was advantageous for the management of the bank
‘Menatep’.

- Protocol of presenting a person for identification with participation of the affected Korneyev D.N with a photoboard, according with which he, based on particularities and marks (height, body-build, face-oval, neck, shin, nose, eye shapes, eyes, lips and general features) recognized Shapiro V.V. as the man, who, January 21, 1998, in his resence, from a hand-gun with silencer, killed his spouse, and then, threatening, aimed his hand-gun at him in the direction of his forehead, saying ‘Quiet, quiet’, and after that he came into elevator’s cabin and disappeared.
Shapiro, after
the process of identification organized by the investigation, said that he
completely agreed with the affected Korneyev D.N., he leaded himself guilty of
killing Ms. Korneyeva.

- Testimony of
the witness Filimonov V.S. during the preliminary investigation and in court,
according to which, on January 21, 1998, between 20.00 and 21.00 p.m., in the
courtyard of the house No 4 in Chechulin Street of the town Moscow, he met two
if his neighbors – the Korneyevs, who came in the entrance of the house.
Approximately in 5 minutes after that, from the distance of about 8 meters, he
saw an unknown man running along their house. He remembered his appearances and
clothes, and could recognized him. On the same day, he learned about the
murders of Korneyeva.

- Protocol of presenting a person for the purpose of identification of the witness Filimonov V.S. with a photoboard, according to which he, based on peculiarities and special marks (height, body-built, face-oval, form of the head, hairs, neck, chin, nose and general face features) recognized Shapiro as the man who, on January 21, 1998, had been running along their house, and that was fine minutes later after he had seen the Gorins coming into the entrance of the house.
Shapiro, who was
being identified, after the mentioned action of the investigation, said that he
completely agreed with the witness Filimonov V.S., he pleaded himself guilty of
killing Ms. Korneyeva.

- Testimony in court of the witness Romanets M.N. according to which, he lives in an apartment situated one floor higher, on the seventh floor of the house Vo 4, on Chechulin Street in the town Moscow. From neighbors he learned that, on January 21, 1998, in the evening, his neighbor Korneyeva V.A. had been shot and killed in plain view of her spouse. In several days prior to the killing of Korneyeva, on the stairwell landing of the eights floor, he had met several times an unknown and suspicious man who, having seen him, had done down the stairwell.
The presented and studies in court, in accordance with Article 281 of the Criminal Procedure Code of the Russian Federation, the testimony, during the preliminary investigation, of the witness Gavrilov S.D., according to which his apartment had been located on the same stairwell landing with the Korneyevs.
On January 21,
1998, about 21.10 p.m., he heard a loud cry of a man. Having come out of his
apartment, he saw Mr. Korneyev who cried ‘They killed her’. On the floor, near
the elevator, lay Ms. Korneyeva, and there was already a stain of blood near
her head. Later he learned that Korneyeva was killed from a firing arm.
Approximately, in two day prior to the killing of Korneyeva, at about 20.00
p.m., he saw on the stairwell landing
between the sixth and sevenths floors, near the rubbish bin, he saw footprints
of men’s shoes, size 43.

- Testimony in court of the witness Portnov O.G. according to which he lived in the apartment Vo XX, located in the first entrance of the house No 4, on the Chechulin Street in Moscow. Visually he was acquainted with Ms. Korneyeva V.A. and her spouse who lived in the apartment located in XX entrance of the mentioned house. On January 21, 1998, about 21.00 p.m., from the words of neighbors he learned that Korneyeva was killed from a firing gun near the door of her apartment in presence of her husband. He knows that she worked as director of a shop in Moscow. He thinks that her murder was connected with her activities as entrepreneur.
- Testimony of the witness Kovalenko V.A. during the preliminary investigation and in court, according to which he, from 1992, had provided juridical services to TS/E ‘TF ‘Feniks’, and Korneyeva V.A. was its director. Approximately from 1993, ‘Feniks’ started to have problems with the bank ‘Menatep’, that, in accordance with the decision of the prefect of Moscow’s Central administrative district, was allowed to carry out a renovation of the building 1, house 8/2 on the Pokrovka Street in Moscow. Part of the premises of the mentioned building was property of the LLC ‘Feniks’, in particular, of the shop ‘Tchai’. For a long period of time, employees of the bank ‘Menatep’ had demanded to vacate the premises. Representatives of the bank ‘Menatep’ adopted a defiant attitude indicating to Korneyeva that they, in any case, will accomplish the set goal directed at the seizure of the premises of the shop ‘Tchai’. After that, contracting entities of the bank ‘Menatep’ ruined part of the premises of the building 1, house 8/2 on the Pokrovka Street, they also damaged the heating and sewerage systems and flooded with water the premises of the shop ‘Tchai’.
At the initiative of the bank ‘Menatep’, in 1994, the State Department of control of preservation and use of historical and cultural heritage of Moscow initiated a plea of nullity to the Moscow Arbitration Court regarding the agreement of sale and purchase of the premises at the address Moscow, Pokrovka Street, houses No 2/1 and 8/2, building 1, belonging to the LLC ‘TF ‘Feniks’. A representative of the bank ‘Menatep’ was always present in all court hearings. By the decision of a judge of the Arbitration Court the claim was dismissed. The LLC ‘TF ‘Feniks’ also filed a plea of nullity in Arbitration Court regarding prefect’s decision to hand over the restored premises where the shop ‘Thai’ was located, to property of the bank ‘Menatep’. This claim was fulfilled.
In November and December of 1997, he, together with Korneyeva V.A., at her request, took part in negotiations with representatives of the bank ‘Menatep’, namely with Gorin S.V. and Nesarenko D.Y. The subject of the negotiations was a proposal from representatives of the bank ‘Menatep’ for the LLC ‘Feniks’ to become a member of a certain company that was to carry out a renovation of mentioned building. For that, the LLC ‘Feniks’ was to bring to the nominal capital of this company the premises of the shop ‘Tchai’ belonging to the LLC on property rights. This proposal was inacceptable for Korneyeva, so she initiated a counter offer, she proposed to the bank ‘Menatep’ to buy out the premises, but the sum of money proposed by the bank ‘Menatep’ was also inacceptable for Korneyeva.
On January 22,
1998, speaking by phone, he learned from the deputy director of the LLC ‘TF
‘Feniks’ Chikanova V.I. about the murder of Korneyeva V.A. According to him,
the death of Korneyeva V.A. was of benefit to somebody of the management of the
bank ‘Menatep”, as all their actions directed at acquisition of the premises of
the shop ‘Tchai’ were a failure.

- Testimony of the witness Korneyev D.D. both during the preliminary investigation and in court, according to which, he explained that, on January 21, 1998, in the evening, his father on the phone had informed him about the killing of his mother who had been one of the founders (51% of the nominal capital of the company) and director of the LLC ‘TF ‘Feniks’. According to the works of his father, when they came out of the elevator and moved to their apartment N XX in house No 4 on Chechulina Street in Moscow, they saw an unknown man on the stairwell landing. His father came up to the door in order to open it, and his mother was behind him. At this moment, his father heard a sharp metallic sound behind him. Having turned around, he saw that Korneyeva, his spouse, is falling to the floor. He looked in the direction of the man and saw that he was standing with his back to the elevator, and he had a gun in his hand that he aimed it threatening at him and said the following words: ‘Quiet, quiet’, and then he came into elevator’s cabin and disappeared.
He knows that 20% share of the nominal capital of the company belonged to Tarakhtelyuk V.G., 10% share of the nominal capital of the company belonged to his brother Korneyev M.D., and 5% of the share of the nominal capital belonged to him. Other cofounders of the company were employees of the LLC ‘TF ‘Feniks’, so the rest 14% of the capital share was divided among them.
During several years, there were litigations between LLC ‘TF ‘Feniks’ and Tarakhtelyuk in connection with the fact that Tarakhtelyuk demanded a ‘natural’ share of the company’s possession. In 2001 Tarakhtelyuk died in a car crash. Tarakhtelyuk’s share of the capital was bought out from his wife and daughter by Korneyev M.D. After the death of his mother, he was elected director of the LLC ‘TF ‘Feniks’ which later was reorganized into the OJSC ‘TF ‘Feniks-Pokrovka’.
The LLC ‘TF ‘Feniks’ had a longstanding conflict concerning of the premises of the company-shop ‘Tchai’ located at the address: Moscow, Pokrovka Street, house 8/2, building 1. The rights for renovation of this building received the bank ‘Menatep’ which had no possibility to carry out a reconstruction without an agreement with their company. The negotiation that his mother held with representatives of this bank about the future of these premises ended in a deadlock because the sides didn’t come to a mutually acceptable decision. A contracting firms of the bank ‘Menatep’ turned off all communications of the shop and put a fence around the whole building that made in impossible for the shop ‘Tchai’ to carry on its normal work.
He also knows that, starting, approximately, from 1997, the bank ‘Menatep’ made numerous efforts to receive from the LLC ‘TF ‘Feniks’ the premises of the shop ‘Tchai’. So, the negotiations on this matter in the interest of the bank ‘Menatep’ were held by the representative of the CJSC ‘Don-Grupp’ Gorin and representative of the CJSC ‘Tekhstroiservis-M’ Nasarenko. These negotiations were actively conducted by his mother in October-December 1997, because the bank ‘Menatep’ already twice missed the terms of the renovation of the building where the shop ‘Tchai’ was located. They proposed to her to sell the premises of this shop, or enter as a founder in the organization created by the bank ‘Menatep’ for renovation of this building. In 1997, Korneyeva V.A. definitely said nay to representatives of the bank ‘Menatep’ and refused both to sell or hand over the premises of this shop.
After her death, Gorin and Nesarenko repeatedly came up to him with the same proposal and, in a in a stark form, demanded the sale of these premises threatening otherwise with different sanctions of administrative and economic character. Once Gorin, in his presence and in presence of the employee of ‘Feniks’ Shidlovsky falsified his signature of a document of his consent to enter the CJSC ‘Don-Grupp’ as a shareholder, and then wrote a certificate that he had falsified this signature. This certificate he voluntary gave up during the seizure of documents.
In June 2003, he,
on the proposition of the general director of the International Financial
Association ‘Menatep’ Ashurkov, sold the premises of the shop ‘Tchai’ to the
Cyprus company ‘GML Estate Limited’ associated with the bank ‘Menatep’. He
suspects that Gorin took part in the murder of his mother, and he organized
this crime in the interests of the management of the bank ‘Menatep’

- Testimony in court of the witness Sidorov V.I., according to which he is a relative of the Korneyevs. Ms. Korneyeva V.A. worked as director of the LLC ‘TF ‘Fenisk’. In January 1998 Morneyeva was killed. From May 1998, on the proposition of the New director of the LLC ‘TF ‘Feniks’ Korneyev D.D., he has been working in the position of managing director of the mentioned company that, later on, was transformed into the JSC ‘TF ‘Feniks-Penrovka’. This company owned as a property the premises of the shop ‘Tchai’ located at the address: Moscow, Pokrovka Street, house 8/2, building 1. In 1998 the shop didn’t work already, as the whole building, where it was located, was scaffolded and all communications wore turned off. He knew that, according to the decision of the prefect of the Central Administrative District of Moscow, the building on Pokrovska Street, house 8/2 was to be renovated.
In February 1998, when he not yet took up his duties, he was present several times at meetings of Korneyev D.D. with representatives of the bank ‘Menatep’ and the director of the form ‘Don-Grupp’ Gorin S.V. who was drawn to the premises of the shop ‘Tchai’ and wanted a most rapid entry of the company to “Don-Grupp’ for carrying out renovation of the building of Pokrovka Street, house 8/2, building 1. Gorin promised to Korneyev for that monetary remuneration and a present in the form of a BMW car. Korneyev was rejecting the offer on the part of Gorin. Also, from the words of Korneyev, he knew that, at one of the meetings, Gorin insistently asked Korneyev to sigh a suite of documents pertaining to handing over of the premises of the shop ‘Tchai’ and offered to Korneyev money and a car.
But when Korneyev yet again rejected the proposal of Gorin, the latter, in his presence, falsified his signature as director of the LLC ‘TF ‘Feniks’ on the mentioned documents and wrote a receipt for him. Moreover, Gorin showed a falsified document of the Bureau of Technical Documentation (BTI) with regards to the premises of the shop ‘Tchai’ and said that he can solve the problem of lifting restrictions on real estate transactions of the company, imposed by the court in connections with claims of one of members of their company Tarakhtelyuk, as well as settle the issue with Tarakhtelyuc and his claims, if only Korneyev D.D. would give up the premises of the shop ‘Tchai’. Apart from that, Korneyev D.D. presented to him Nesarenko as a lawyer of Tarakhtelyuk. From the behavior of Tarakhtelyuk it was clear that he was not the initiator of these claims, and that somebody was manipulating with him.
Approximately in 2002, he, once again, started to deal closely with the premises of the shop ‘Tchai’. He saw that the renovation of the building was in full swing. On the doors of the premises of the shop ‘Tchai’ there were other locks, and the basement of the shop was totally destroyed. He learned that the object was watched by the security structure of the International Finance Union (IFU) ‘Menatep’. After that, he met with the general director of the IFU ‘Menatep’ Ashurkov, who made a proposal pertaining to the entry of the shop ‘Tchai’ in the project of the reconstruction of the building or selling of the shop ‘Tchai’. In the spring of 2003, this proposal was discussed at the meeting of the founder of the company, and they decided to sell the premises of the shop ‘Tchai’. The premises of the shop ‘Tchai’ was sold to the company ‘GML Estate Limited connected with the bank ‘Menatep’, with the director of the former being Kotelnikova O.I. and the lawyer of the MFU ‘Menatep’ Kez S.V. was dealing with legal arrangements.
He also knows that representatives of the bank ‘Menatep’ repeatedly proposed to the founders of ‘Feniks’ to sell their share in the nominal capital of the company. According to him, the murder of Korneyeva was beneficial to the management of the bank ‘Menatep’, and in was connected with her refusal to sell the premises of the shop ‘Tchai’ on unfavorable conditions for the company.
- Testimony in court of the witness Shidlovsky P.Y., according to which he keeps friendly relations with Korneyev D.D. On January 22, 1998, he learned about the murder of Korneyev’s mother, who had been shot near the door of her apartment in plain view of her spouse. He knew that Korneyeva V.A. had repeatedly met with representatives of the bank ‘Menatep’ that had become rights to renovate the building at the following address: Moscow, Pokrovka Street, house 8/2, building 1. In this building there where the premises of the shop ‘Tchai’ that belonged to the company as its property. The contracting organization of the bank in the building where the shop ‘Tchai’ was located, all communications were turned off, and the building was surrounded by a fence. He supposes that the murder of Korneyeva V.A. was connected with her unwillingness to sell the premises of the shop ‘Tchai’ to the bank ‘Menatep’.
After the death of his mother, Korneyev D.D. was selected as director of the LLC ‘TF ‘Feniks’, and he (Shidlovsky) was appointed deputy director of the company. He repeatedly was present at negotiations when Korneyev D.D. conducted with the representatives of the bank ‘Menatep” Gorin and Nesarenko, who said they were employees of the firm ‘Tekhstroiservis-M’ and ‘Don-Grupp’. They insistently proposed to Korneyev to join their investment project of the renovation of the building at the address: Moscow, Pokrovka-Street, house 8/2, building 1.
Once, on their proposition, he, together with Korneyev, held similar negotiations with representatives of the bank ‘Menatep’ in the office at the address: Moscow, Vavilova Street, house 23. Gorin and Nasarenko didn’t show them any concrete documents, but insistently demanded to agree with their proposal saying that later the premises of the shop ‘Tchai’ would be impossible to sell at a market price, as it would be definitely ruined. Gorin repeatedly tried to persuade Korneyev to agree with his conditions saying that, otherwise, he could loose all, proposed. As a remuneration, a car BMW. One Gorin, in his presence, falsified Korneyev’s signature in a commercial proposal in connection with the project of renovation of this building, and then wrote a certificate about that and gave it to Korneyev.
In 2002, he left the company. He knows that Korneyev sold the premises of the shop ‘Tchai’ to one of the structures belonging to the bank ‘Menatep’. As of today, from mass-media, he knows about the murder of Gorin and his spouse.
- Testimony in court of the witness Chikanova V.I. who says that she had been acquainted with Korneyeva V.A. since 1981, and had kept friendly ties with her. At the invitation of Korneyeva, she has been working in the LLC ‘TF ‘Feniks’ since May 1992 as a deputy director. Until January 21, 1998, Korneyeva V.A. was the director of this company, who, simultaneously owned 51% of the nominal capital of the company ‘Feniks’. Apart from Korneyeva, the owners of the nominal capital was Tarakhnelyuk V.G. whom belonged 20% of the share, and Korneyeva’s sons Dmitry and Mikhail as well as several member of the stuff of the company.
According to her knowledge, Tarakhtelyuk, from 1995, demanded to separate his share from the nominal capital ‘in a natural form’, and in this connection, he brought a civil claim in The Basmanny District Court in Moscow. A counter-claim was brought also the company ‘Feniks’ about exclusion of Tarakhtelyuk from members of its founders. Apart from that, approximately from 1995, the company had litigations with the bank ‘Menatep’ what had started to make a renovation of the building at the address: Moscow, Pokrovka-Street, house 8/2, in which the shop ‘Tchai’ was located which belonged to the LLC “TF Febiks’. The office of the bank was near on Kolpachny Lane.
The management of the bank ‘Menatep’ decided to buy out the premises from the LLC ‘Feniks’ or exchange this premises, but the proposed conditions were unfavorable for the company, and because of that Korneyeva refused to do that. The following relations with the company and the bank became of hostile nature, and during the renovation of the building, a material damage was inflicted on the shop ‘Tchai’ as the heating system was unfrozen and the premises was flooded with water. In light of the given situation, the bank ‘Menatep’ missed the terms of the final renovation of the building which had been confirmed by the Moscow City Government.
At the end of 1997, the representatives of the bank ‘Menatep’ Gorin and Nasarenko repeatedly came to Korneyeva with a proposition to sell the shop ‘Tchai’ to the bank ‘Menatep’ or to enter in a new firm created for the renovation of the building. But the conditions proposed by them were unexpectable. Apart from that, she was present at several court hearings in connections with claims of Tarakhtelyuk and saw Nesarenko in the court room.
During the last days of her life, Korneyeva was excited by something. On January 21, 1998, at about 22.00 p.m. she received information about the murder of Korneyeva. From the words of her spouse, she knows that details about the killing – when the Korneyevs came together out of the elevator, they noticed a unknown man on the stairwell landing. Mr. Korneyev came up to the door of the apartment in order to open it, and Ms. Korneyeva was behind him. At this moment, he heard a metallic sound. He turned around and saw his wife falling to the floor, and that man was holding a hand-gun in his hand. After that he disappeared.
- Testimony in court of the witness Bakulina A.A. – she had worked in the LLC ‘TF ‘Feniks’ as chief accountant since 1994. The founders of the company were the following persons: the Korneyevs, Tarakhtelyuk, Akekseyeva, Basanov, Karasyova, Maltseva, Tomson, Groshkova, Losgachova. The biggest share in the nominal capital had Korneyeva V.A. (51%), Tarakhtelyuk V.G. (20%) and Korneyev M.D. (10%). The rest of the founders had from 1% to 5% share in the nominal capital of the company. She knows that between the company and Tarakhtelyuk there was litigations. Tarakhtelyuk died in a car accident.
She learned about the murder of Korneyeva in the evening of January 21, 1998. Korneyeva, near the door of her apartment, was killed in the presence of her spouse, a man who then fled. Tarakhtelyuk V.G. was apprehended on suspicion of killing Korneyeva, but he was freed in several days, as his involvement in this crime was not determined. She thinks that Tarakhtelyuk is not connected with the killing of Korneyeva.
According to her, the death of Korneyeva might be beneficial to somebody from the management of the bank ‘Menatep’, as she didn’t want to sell to this bank the premises of the shop ‘Tchai’, belonging to the company on the property rights. From 1993, the bank Menatep’ received the right to renovate the building at the address: Moscow, Pokrovka-Street, house 8/2, building 1. Representatives of the bank ‘Menatep’ often came to Korneyeva, once she saw Nevzlin himself, whom Korneyeva saw to the door, and, according to the latter, he had demanded to sell the premises or lease them.
- Testimony of Tarakhtelyuk V.G. announced and stidied in court in connection with his death and given by hi, during the interrogation as a witness of 22.01.98 and as a suspect of 23.01.98, according to which he explained that he is a cofounder of the LLC ‘Feniks’. Owns 20% of the nominal capital. He took part in the court proceedings on resigning from membership of the cofounders of “Feniks’.
He had disagreements with Korneyeva V/A. as director and owner of 51% of the nominal capital, and he had disagreements on the method of counting his share of the nominal capital and, accordingly, its amount expressed in monetary terms. He was intended to settle the mentioned above disagreements in court, that is why he had nothing to do with the murder of Korneyeva V.A.
On January 21, 1998, at the supposed time of the Murder of Korneyeva V.A., he was in a car, belonging to the state municipal company ‘Tekhekonomservis’ of which he was director. At this time, he, together with his chauffeur, was on his way home located in the town Lobnya, Moscow Region. The circumstances are known to him of the negotiations of Korneyeva V.A. with representatives of the bank ‘Menatep’ on the future of the premises of the shop ‘Tchai’, at the address: Moscow, Pokrovka Street, house 8/2, building 1.
The
representative of the bank ‘Menatep’ Nasarenko met with him personally several
times, and he reasoned him to influence Korneyeva in order to make he agree
with their proposal to enter with the premises of the shop ‘Tchai’ into a joint
stock company which had been created for the renovation of the building.

- Testimony in court of the witness Nasarenko D.Y. according to which he, from 1997, had worked as employee of the Security Department of the CJSC ‘Tekhstroyservis-M’, as well as in Forth Department of the Department of Economic and internal security of the oil company Yukos, headed by Pichugin A.V. The office of the Security service was located at the address: Moscow, Vavilova Street, house 23.
In November 1997, under the instruction of his boss Puchigin A.V., together with the head of the company ‘Don-Grupp’ Gorin S.V. who was presented to him by Pichugin, he conducted several meetings with the director of the LLV ‘TF “Feniks’ Korneyeva concerning the settlement of differences which had been arisen between the bank ‘Menatep’ and the LLC ‘Feniks’ in connection with the premises in the building at the address: Moscow, Pokrovka Street, house 8/2 destined to renovation, of the premises of the shop ‘Tchai’ belonging to the LLC ‘Feniks’. The aim of his participation in the negotiations was to clear connections of the LLC ‘Feniks’, as a possible partner, with representatives of organized criminal groups. Korneyeva refuse to hand over the premises of the shop, as she was not satisfied with the prize proposed by the bank, and she was also not satisfied with other variants, including exchange for another premises.
Also, in order to ascertain all circumstances, in the premises of the Basmanny District Court in Moscow he met with one of the co-founders of the LCC ‘TF ‘Feniks’ Terakhtelyuk V.G. who had litigations with the company. After thr murder of Korneyeva, he and Gorin took part in similar begotiations with the new director of the LLC Korneyev D.D.
- Testimony of Gorin S.V. announced and studied in court in connection with his death, evidence given by him as a witness on March 3, 1998, according to which he is the director of the CJSC ‘Don-Grupp’ founded by the CJSC ‘Top-Master’ and the CJSC ‘Pokrovka’ connected with the bank ‘Menatep’, for conducting renovation of the building at the address: Moscow, Pokrovka Street, house 8/2, Par of the premises in the mentioned building (the shop ‘Tchai’) belonged to the LLC ‘TF ‘Fenoks’ the director of which was Korneyeva V.A.
…According to the information that he received from Pichugin A.V., head of the security service of the bank ‘Menatep’ and simultaneously of the CJSC ‘Nekhstroiservis-M’, the director of the LLC ‘TF ‘ Feniks’ Korneyeva announced her willingness to enter into the CJSC ‘Don-Grupp’, organized by him, with the premises of the shop occupying part of the spaces in the building under renovation. After that, he, together with the employee of the security service of the CJSC ‘Tekhstroiservis-M’ Nasarenko several times met with Korneyeva V.A. At these meetings, they discussed conditions of the entering of the LLC ‘TF ‘Feniks’ into the CJSC ‘Don ’Grupp’. He knows that one of the founders of the LLC ‘TF ‘Feniks’ filed a suit in court pertaining to separation of his share, and in connection with that restrictions were hanged on deals with the property of this company. Such conditions didn’t satisfy the bank ‘Menatep’, and because of that they were ready to compensate to Tarakhtelyuk his share.
After the death
of Korneyeva, he started to carry out negotiations with the new director, with
Korneyev D.D. who, as it turned out, was not articulated on the plans of
Korneyeva to enter into the CJSC ‘Don-Grupp’, and that is why he didn’t support
this idea in connection with his concerns of the future bankruptcy of the CJSC
‘Don-Grupp’ and subsequent loosing of the premises deposited in the nominal
capital. In response, they said that nobody was guaranteed against bankruptcy,
and in the LLC ‘Feniks’ one could also find some violations of financial and
fiscal character.

- Testimony in court of the witness Lysikov S.V., according to which, he has known Pichugin for a long time, and has been keeping with him friendly relations. On the recommendation of Pichugin he was employed as deputy general director of the CJSC ‘Moscow Youth Palace’, had he has been holding un to present time. With Gorin and his spouse he got acquainted via Pichugin, who had some mutual deals with Gorin. Several times, Gorin met with Pichugin in the “Moscow Youth Palace’, as well as near it, several times Gorin along or with his spouse had dinner in a restaurant located in the “Moscow Youth Palace’, and once his chauffeur Mikhail (Ovsyannikov) came with him.
Approximately, in 1996-1997, he bought for private use the car ‘Volvo-240’. He doesn’t remember where placed this car at the disposal of Gorin, but he thinks that, had he made such a request, he would have given him his car. In 1998, he bought from Gorin the car BMW-525, a red one, which was registered in the name of Gorin’s mother-in-law.
- Announced and investigated in court in accordance with Article 281 of the Criminal Procedure Code of the Russian Federation, testimony of the witness Ms. Markovnikova L.V., during the preliminary investigation, according to which, she was a relative of Olga Gorina.
Approximately, in
1998-1999, she got acquainted with her husband Gorin Sergey. The Gorins, for
about half a year, dwelled in her apartment in the town Vidnoye in the Moscow
Region, ad the address: Lesnaya Street, house 6, apartment 13. According to
their words, she learned that they dealt with commercial matters connected with
banking activities. Gorina O. asked that nobody should come to them and didn’t
disturb them, as they didn’t like it. During their dwelling in her apartment,
their chauffeur Mikhail (Ovsyannikov) stayed with them, whom she had seen in
the town Tambov, he had lived in the same house with Dedova G.A. In November
2002, from the relatives living in the town Tambov, she learned about the death
of the Gorins.

- Testimony in court of the witness Mikhailina S.N., according to which her sister Markovnikova L.V., approximately in 1998-1999, for several months, rented out an apartment located in the Moscow Vidnoye, Moscow Region, at the address: Lestaya Street, house 6, apartment 13, to her relatives Gorina O.M. and her spouse Gorin S.V. The latter very often came to Moscow on their way, and before and after that, rented an apartment of her sister. From the words of the Gorins, she knew that their activities were connected with the bank ‘Mernatep’ and the oil company Yukos. Olga Gorina tried to get a job with one of these companies. The Gorins made impression of affluent people, they had jewels, expensive office machines and equipment, a snow machine, used various cars which, normally, were driven by a chauffeur who followed them. One of the cars were stolen during their sojourn in the town Vidnoye of the Moscow Region.
In 1999, she saw a snow machine in the house of the Gorins in the town Tambov, that nobody used. Gorin didn’t allowed to Olga to communicated with anybody, even with her relatives. First, she thought that he was simply jealous. But then she understood that he was afraid Olga could tell to somebody information she knew.
Gorin himself was very secretive and pathologically greedy. From persons making the entourage of the Gorings and often accompanying them, she knows the following: Peshkun Alexey, former police officer by the name Vologya (Shapiro), from the town Volgograd, Pichugin Alexey from Moscow and the man by the name Mikhail (Ovsyannikov) from the town Tambov. One she was driven by a SUV car from Tambov to Moscow which belonged to Vladimir. About the death of the Gorins she learned from her relatives.
- Testimony in court of the affected Dedova G.A., according to which, in 1995, her daughter Ismaylova Olga, took a job with an affiliate of the bank ‘Menatep’ in the town Tambov, headed by Gorin Sergey. In 1999, Ismaylova solemnized a marriage with Gorin together with whom she started to live in the house No XX, Yasnaya Street, community Raduzhny of the town Tambov. In the period from 1998-2000, the Gorins worked somewhere in Moscow. When they returned to Tambov, Gorin continued periodically going to Moscow. In Moscow, the Gorings lived in various hotels, and also rented apartments from their relatives the Markovs in the town Vidnoye, Moscow Region.
In August 2000, in connection with the name day of the Gorins’ newly born son, Pichugin came to visit them from Moscow. From the words of Gorin, she knew that he had known Pichugin for about eight years. Later on, Gorin tried to get a job in the oil company Yukos, but nothing was coming out of it. Goring S. reckoned in this matter only on Pichugin. During a long period of time, the latter promised to the Gorins to provide a job, but did nothing for that. Gorin said that Pichugin could get him a job in the mentioned company, if he wanted to. After the Gorins disappeared, Pichugin started to call often and asked about investigative measures, and also came to the town Tambov to ascertain the circumstanced of the committed crime.
- Protocol of the
crime scene of inspection of 21.01.98, according to
which the corpse of Korneyeva V.A., found on the stairwell landing of the sixth
floor, in the house No 4 on Chechulina Street in Moscow, is places with its
legs at the direction to the mutual door of the apartments No XX and XX, the
head touches the first step of the stairwell leading to the seventh floor of
the mentioned house. During the external examination of the body of Korneyeva,
a damage was found on the front, in the form of round defect of the tissues,

- Conclusion of the forensic medical examination No 0135 of 30.01.1998 and No 38/98 of 29.01.98. according to which death of Korneyeva V.A. was cause by the contusion-destruction of the brain as the result of the blind fire arms wound of the head. During the forensic medical examination of the corpse of Korneyeva V.A., a blind fire arms wound of the head was detected:
- skin wound of the forehead (entry wound, diameter 0.5 cm what was located one centimeter higher of the external end of the right eyebrow ridge. The wound canal had a direction front back, from right to left, bottom upwards, and it ended blindly on the level of the left bregma bone. At the end of the would canal, there was a shell bullet, 1.4x0.56 cm.
From the moment of death to the moment of fixation of putrid phenomena on the scene of the crime (22.20 p.m., according to the inspection protocol) passed about 2-3 hours.
The blind bullet wound of the head was caused by a fire arms round fit up with a bullet that contained copper. The shot at the head was fired from a non-close distance, outside the limits of effects due to additional factors of close shot (in connection to the hand gun PSM, beyond 100 cm), provided that the skin was the first barrier.
A blind fire arms bullet wound with contusion-destruction of the brain, on the basis of ganger to life, is qualified as grievous bodily harm and is in direct connection with a cause of the death. The direction of a fire arms wound canal of the head coincided with the position of the barrel of a firearm.
The death of the
victim was caused by the blind firearm bullet wound of the head, and after that
she was incapable of making any active actions.

- Conclusion of the forensic ballistic examination No 12/887 of 16.02.98, according to which the cartridge found during the crime scene examination at the address: Moscow, Chechulina Street, house 4, and the bullet removed from the corpse of Korneyeva V.A. are parts of a standard 5.45 mm handgun round to the handgun PSM (self-loading handgun, small-size).
The bullet would
be fired from a standard barrel, caliber 4.45 mm with six grooves, right
directions, with width 1.3-1.4 mm and angle of slope about 4 degrees, or from a
self-made barrel with similar construction of the canal. Speaking of standard
models, it could be a handgun PSM, caliber 5.45. Probably, a silencer was used
in this case. A cartridge of this type could be used in the handgun PSM or in a
handgun remade from a gas one on the basis of a PSM (IZH 78-7.6, IZH 78-8)

seizure of 22.01.98, according to which from the
Thanatological Department No 4 of the Lefortovo mortuaries of the Bureau of the
Forensic Metical Examination of the Committee of Public Health of Moscow the
bullet found in the head of the corpse of Korneyeva V.A. was taken, as well as
the clothes from her dead body.

Having analyzed the presented proofs, the Court has come to the conclusion that Gorin S.V. had knowledge that Pichugin A.V. and Nevzlin L.B. were ordering customers and organizers of the Murder of Korneyeva, and, moreover, the latter (Nevzlin L.B.) financed this crime. This information Gorin didn’t hide from his wife Gorina O., as well as from persons which whom he had committed this crime, i.e. from Shapiro V.V. and Ovsyannikov M.V., and they gave evidence during the preliminary investigation and in court, which the Court recognizes as veracious in connection with its confirmation by the whole other proofs in this case.
That is why the Court holds that the guilt of the defendant Nevzlin L.B. in organizing the murder of Korneyeva V.A., together with Pichugin A.V. and committed by Shapiro N.V. with participation of Ovsyannikov M.V. for hire, is completely established.
Arguments of the defense of the defendant Nevzlin L.B. about absence of proof in accusations of organizing the murder of Korneyeva V.A. and that Nevzlin L.B., according to the defense, gave instructions to the director of the CJSC ‘Don-Grupp’ Gorin and employee of the CJSC Nasarenko D.A. on carrying out negotiations with Korneyeva about selling the shop ‘Tchai’ and that Nevzlin criminally conspired with Pichugin with the purpose to kill Korneyeva, are totally disposed by the presented proofs, in particular, by the evidence of the witnesses Shapiro and Ovsyannikov, given during the preliminary investigation, as well as in court, as well as by the witness Smirnov O., affected Korneyev D., witness Kovalenko V., Korneyev D., Sidorov V., Bakulina, Chikanova and others, as well as by the protocols of seizure and inspection of documents in the LLC ‘TF ‘Feniks’ and by other proofs”.
