“The defendant Nevzlin L.B. organized the execution of a series of extremely serious crimes - crimes under the following circumstances: Nevzlin L.B. together with Pichugin A.V. organized the killing of Korneyeva V.A. which was committed on January 21, 1998, in the town Moscow in collaboration with Ovsyannikov M.V., with the verdicts against them have become final and biding.
By the ruling of the prefect of Moscow’s Central administrative district from March 25, 1993, it was allowed to the incorporated innovative bank of scientific-technical progress ‘Menatep’ (further the bank ‘Menatep’) to carry out a renovation of the following objects – buildings 1 and 2, located on the Pokrovka street, house 8/2 in Moscow with the following long lease of it for the term of 25 years on with the right of a purchase option on account of compensation of expenditures on removal and reconstruction. The bank ‘Menatep’ in order to accomplish this reconstruction, engaged the companies ‘Mekhstroyservis-M’ and CJSC ‘Don-Grupp’ which were under its control.
By the decision of the Arbitration Court of Moscow of April 23, 1998, the mentioned decision with regard to the transfer to the bank ‘Mrnatep’ after the reconstruction of building 1 and 2, house 8/2, on the Pokrovka street, was hold invalid.
In spite of that, the director of the CJSC ‘Don-Gripp’ Gorin S.V. (the criminal prosecution of him was dropped in connection with his death), and another person, acting on the behest Nevzlin l.B., first deputy of the Board of the bank ‘Menatep’, in the period from November to December 1997, conducted negotiations with the director of the LLP ‘Trade firm ‘Feniks’ Korneyeva V.A. who owned 51% of the nominal capital of the said enterprise, during which they proposed to sell the premises of the shop ‘Tchai’ situated in the building 1, house 8/2 on the Pokrovka atreet in Moscow or to enter with this immovable into the nominal capital of the organizations being engaged be the bank ‘Menatep’ as a co-founder, for carrying out reconstruction of the whole building.
Commercial proposal with regard to selling and handover the premises of the shop ‘Tchai’ to the organizations controlled by the bank ‘Menatep’ contradicted to personal and business interests of Korneyeva V.A. and were rejected by her because of their unprofitability and inexpediency for the LLC ‘Trade Frim ‘Feniks’.
Failed to achieve the intended results in the course of the negotiations with Korneyeva V.A., Nevzlin l.B., in an undisclosed location, conspired criminally with Pichugin A.V., head of the security department of the bank ‘Menatep’, concurrently head of the economic security department of the CJSC ‘Tekhstroyservis-M’ (sentenced by the Verdict of the Moscow City Court of 06.08.2007 which has become effective in law), as well as with several other persons unidentified by the Court from among senior officers of the bank ‘Menatep’ with the aim to murder Korneyeve V.A. whose actions contradicted their personal and business interests.
With the purpose to make these criminal intentions to reality, Pichugin A.V., acting under the direct instructions of Nevzlin L.B., who took up the mantle of organizer of the killing of Korneyeva V.A., in an undisclosed time and location, proposed to his acquaintance Gorin S.V., to try to find persons ready to commit this crime for a reward.
Having accepted this proposal from Nevzlin L.B. and Pichugin A.V., Gorin S.V., at undisclosed time and in undisclosed location, for a reward, induced to murder Korneyeva V.A. his acquaintances Shapiro V.V. and Ossyannikov M.V (they have been accused in accordance with the Verdict of the Moscow City Court of 17.08.2006 which have become law); he passed over to each of them as a reward not less than 5000 US dollars (29,800,000 rubles) received from Nevzlin L.B. through Pichugin A.V., and later also an automobile ‘Hyundai Galloper’ which later was given to Shapiro V.V.
According to the role distribution, it was Shapiro V.V. who ought to commit directly the murder of Korneyeva V/A/, and Ovsyannikov role was to bring Shapiro V.V. to the scene of the crime, to flee from the scene of crime as well as get rid of obstacles in the course of carrying out this crime.
In the period from November 1997 up to January 1998, in pursuance of the orders received from Nevzlin L.B. and Pichugin A.V., Gorin S.V., Ovsyannikov M.B. and Shapiro V.V., in order to make possible this crime, having in advance established identity of Korneyeva V.A. and her place of the domicile, several times went to Moscow on the cars BMW, state registration number A 524 AA 68 РУС and VAZ 21099, state registration number А 292 00 68 РУС, and came close to the house of Korneyeva V.A. collated on Chechulina Street, House No 4, where they for a prolonged period of time tracked the surrounding quarters, as well as time and route of her movements.
In order to fulfill their criminal intentions, directed at murdering of Korneyeva V.A., Gorin S.V., sing at the address Moscow Region, town Vidnoye, Lesnaya Street, House 6, App. 13, handed over to Shapiro a gun PSM 5.45 mm with a silencer, as well as ammunition rounds for it.
On January 21, 1998, between 20 and 21 o’clock, Gorin S.V., together with Shapiro V.V. and Ovsyannikov M.V., trying to carry out the assignment of Nevzlin L.B. and Pichugin A.V. directed at murdering Korneyeva V.A., accived by car to the house No4 on Chechulina Street in Moscow. Around 21 p.m. Shapiro V.V. being in stairwell landing near the door of the apartment No 57, second entrance, of the mentioned house, fired a shot to the head of Korneyeva V.A. making it in extremely brutal manner, in the presence of Korneyev D.N., husband of the victim, inflicted grievous bodily harm to Korneyeva V.A. in the form of a blunt fire arm wound of the head with a bad injury – the destruction of the brain, as the result of which the victim died on the scene of the event.
